Ombudsman
Ombudsman are advocates for residents of nursing homes, board and care homes, and assisted living facilities. Ombudsman are specifically trained to resolve problems you may have related to care received in any of these types of residencies. Your matters are required to be kept confidential unless you agree to share concerns. Under the federal Older Americans Act, every state is required to have an Ombudsman Program.

Department of Health
Each state’s Department of Health serves as an enforcer for Nursing Home quality of care. Though methods may vary by state they are required to uphold that these state-funded facilities follow both state and federal regulations. Be sure to check out your state’s Department of Health website for posted surveys when researching the quality of care of a Nursing Home. For example, see Pennsylvania’s here.

Performs annual inspections of Nursing Homes
Annual Surveys
Surveys can take several days. They are unannounced and happen day or night. Surveys consist of evaluating and interviewing residents, and touring the facility.
Reports
After surveys, written reports are given to the nursing home – if problems are identified, there are different consequences depending on severity:
- Imposing a ban on admissions
- Issuing a provisional license
- Revoking a license
- Losing the right to participate in federal medicare or state Medicaid programs
- Imposing a civil money penalty
